▶ 체코 미성년자 여행안내


체코는 쉥겐조약 가입국으로 부/모 미동행 미성년자 여행 시 공증된 영문 부모동의서가 필요합니다.

미성년자와 함꼐하는 경우, 부모의 서면동의 공증 필요


단기 여행일 지라도 미성년자가 부모 중 1인과만 체코를 여행할 경우 미동행 부모의 동의를 얻어 출국했는지를 입증하기 위해 부모동의서를 구비할 것을 권고합니다. 

부모동의서에는 미성년자와과 동반자의 개인정보, 여행 날짜가 충분히 명시 되어 있어야 합니다 .  또한 미성년자의 가족관계/친권 입증서류를 지참하는 것이 좋습니다. 
부모동의서는 공인 번역을 받거나 공증을 받는 것이 좋습니다.

We travel with children, written consent of parents


In the event that  a minor is traveling accompanied by a person other  than a parent/legal guardian, we recommend checking with the embassy of the country you are visiting whether, in addition to a valid travel document, the written consent of the parents/legal guardians will also be required for the child's travel abroad (the Ministry of Foreign Affairs of the Czech Republic does not have list of countries that have this obligation enshrined directly in their legislation). Travel conditions can also be consulted on the website of the Ministry of Foreign Affairs of the Czech Republic ( States of the world - travel information ).


In general, the consent of the other parent is usually not required for a short-term trip abroad or on vacation. However, it is advisable to get the consent of the other parent to travel, especially for longer stays abroad , when it could happen that the other parent marks this travel as child abduction. Despite the above, it is recommended to arrange with consent also for short-term stays abroad, especially if  the child is traveling with only one parent . The reason for this is to prevent one parent from moving the child outside the country of habitual residence without the knowledge/consent of the other parent. Obtaining consent can also be recommended for unmarried couples and parents who have a different last name than the child, grandparents and when a minor is traveling alone. A photocopy of the child's birth certificate can be attached to the consent. It is strongly recommended to have this consent when traveling outside EU countries/outside Europe, as well as in case of doubt or unclear conditions.


In the written consent to the trip, it is  necessary to sufficiently identify the child and the accompanying person (indicate the first and last name, date of birth and travel document number), the destination and the date of the trip. It is also recommended to have a photocopy of the minor's birth certificate with you (in the case of small children), or a court decision on custody of the child.


It is advisable for the person giving written consent to have the signature officially verified (municipal office, post office with Czech Point service, etc.). In addition to Czech, written consent is also recommended to be given in a foreign language used in the destination for which it is intended. However, it must be taken into account that an official translation of the consent granted in the Czech language, on which the signature is verified, would then have to be obtained, or the signature on the consent in a foreign language would have to be verified by a notary who speaks this foreign language. With a request for verification of the signature on a foreign language document, it is possible to contact the embassy of the country of travel, if legalization is carried out. When writing consent in the form of a bilingual or multilingual text, the post office/municipal office will not verify the signature

 

  

 EU 쉥겐조약: 가입국간 국경 이동에 대한 공동협약


체코가 가입한 쉥겐조약은 EU 회원국간 무비자 통행을 규정한 조약으로 가입국간 같은 출입국 규정을 공유합니다.

쉥겐조약은 미성년자의 출입국에 대해 가입국의 국경관리국은 “부모1인 동행 시 상대 배우자의 적법한 동의를 얻었는지를 심층 심사하고, 부모 모두가 미동행한 경우 부모의 적법한 동의를 얻었는지 철저히 확인해야 한다”고 규정하고 있습니다.


가입국가의 출입국은:

6.1조. 부모동행 여부와 관계없이 미성년자에 대해 각별한 주의와 심사를 해야함.

6.2조. 부모동행 시 보호자가 친권 또는 적법한 보호자 자격을 갖추고 있는지 심사하고, 부모 1인 동행 시 상대 배우자의 적법한 동의를 얻었는지 심층 검사를 해야함.

6.3조. 부모 모두가 미동행한 경우 부모의 적법한 동의를 얻었는지를 철저히 확인해야함.

Minors

6.1. Border guards shall pay particular attention to minors, whether travelling accompanied or unaccompanied. Minors crossing an external border shall be subject to the same checks on entry and exit as adults, as provided for in this Regulation.

6.2. In the case of accompanied minors, the border guard shall check that the persons accompanying minors have parental care over them, especially where minors are accompanied by only one adult and there are serious grounds for suspecting that they may have been unlawfully removed from the custody of the person(s) legally exercising parental care over them. In the latter case, the border guard shall carry out a further investigation in order to detect any inconsistencies or contradictions in the information given.

6.3. In the case of minors travelling unaccompanied, border guards shall ensure, by means of thorough checks on travel documents and supporting documents, that the minors do not leave the territory against the wishes of the person(s) having parental care over them.
